Resolution lacks legal validity: Leader of Opposition

Srinagar, Nov 6: The Bharatiya Janata Party (BJP) senior leader and the Leader of the opposition in the J&K Assembly Sunil Sharma Wednesday said that the resolution passed by the J&K Assembly was “unconstitutional” and sans “legality and validity”.

Talking to reporters after the adjournment of the house, Sharma said that the resolution passed by the assembly had no sanctity.

He said that the J&K Assembly was not above the Parliament or the Supreme Court.

“As per the Supreme Court verdict 141 and the verdict 246 of the Parliament, the ruling party has degraded the sanctity of the law. They have broken the sanctity of the Speaker. The Speaker, who is the custodian of the house, today worked as an agent of a particular party,” Sharma said.

He said that the members had to debate and discuss the address of the Lieutenant Governor but the ruling party members “cleverly” moved a resolution.

“I believe that they have broken the sanctity of this house and we have received reports that the Speaker who is the custodian of the House on Tuesday evening drafted this resolution while sitting with the ministers,” Sharma said.

He said that as per the business of the house, two people from the ruling party were supposed to speak with a vote of thanks and after that other MLAs had to speak in the house.

“We won’t allow the house to run and are working on withdrawal of resolution,” Sharma said.

He said there was a rat race among the political parties but they all know nothing is going to happen about the restoration of Article 370 and Article 35-A.

“The act has been passed by the biggest temple of democracy,” Sharma said. “It has been buried and is history now.”

He accused the National Conference (NC) of bringing the resolution, suggesting it was a tactic to mislead the people.

“NC has consistently constructed fake narratives to influence the public,” Sharma said. “The NC is struggling to accept the changes brought since the revocation of Article 370, which have brought peace and prosperity to J&K.”

“Omar Abdullah and the NC know that Article 370 cannot be restored,” he said.

Sharma also asked Congress to clear their stance on the resolution.

“They too stood and supported it,” he said.
