Police officer to pay ‘reasonable expenses’ to person called for appearance in investigation

Jammu, Jan 12: The Police officer will have to pay “reasonable expenses” to the person called for investigation of any case under Section 179(1) BNSS, 2023 for appearance “at any other place other than his residence.”

The provision has been notified by the J&K government, in the exercise of the powers conferred under sub-section (2) of Section 179 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, read with S O No 2506 (E) dated June 28, 2024, of the Ministry of Home Affairs, Government of India.

“Any police officer making an investigation under Chapter XIII of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 may, by order in writing, require attendance of any person who appears to be acquainted with the facts and circumstances of any case as provided under Section 179(1) BNSS, 2023,” read the notification of J&K Home Department.

“Further, reasonable expenses, as specified, shall be paid to such a person by the police officer for attending at any place other than his residence. of which proper account shall be maintained. The expenditure on this account shall be borne out of the Account Head- 2055 (49) by the concerned DDO,” it has been specified.
