Information of Arrested Persons Rules, 2025, notified

Jammu, Jan 12: The J&K government has notified rules pertaining to information of arrested persons; procedure for investigation to be followed by an officer in charge of the Police Station and information to court in non-cognizable cases and investigation of such cases.

Rules have been notified by the J&K Home Department through separate three notifications.

Under the rules regarding “Information of Arrested Persons Rules, 2025”, the Police officer is duty-bound to provide information about arrested persons and offences committed.

“Information of Arrested Persons Rules, 2025”, as per notification, have been made by J&K Government in the exercise of the powers conferred under the sub-section (3) of section 48 of the Bharatiya Nagarik Suraksha Sanhita, 2023 read with S O No 2506 (E) dated June 28, 2024 of the Ministry of Home Affairs, Government of India.

“Procedure for the investigation to be followed by an officer in charge of Police Station, Rules, 2025” have been made in exercise of the powers conferred under the sub-section (2) of section 176 of the Bharatiya Nagarik Suraksha Sanhita, 2023 read with S O No 2506 (E) dated June 28, 2024 of the Ministry of Home Affairs, Government of India.

“Information to court in non-cognizable cases and investigation of such cases Rules, 2025” have been made in exercise of the powers conferred under the sub-section (1) of section 174 of the Bharatiya Nagarik Suraksha Sanhita, 2023 read with S O No 2506 (E) dated June 28, 2024, of the Ministry of Home Affairs, Government of India.

Rules pertaining to “Information of arrested persons” specify the duties of the Police officer regarding giving information as provided under section 48 of Sanhita.

As per rules, the Police officer or any other person making any arrest under this Sanhita is duty bound to provide information regarding the offence committed as specified in clause (c) of sub-section (1) of section (2) of this Sanhita.

Every Police officer or any other person making any arrest under this Sanhita will give the information regarding “such arrest and place where the arrested person is being held to any of his relatives, friends or such other persons as may be disclosed or nominated by the arrested person to give such information and also to the designated police officer in the district as provided under section 37 of Sanhita.”

“An entry of the fact as to who has been informed of the arrest of such person shall be made in the book as specified in rule 2(b) of these Rules, to be kept in the police station in specified form without any delay,” the Rules specify.
