The court's proclamation notice read that the accused have been named in case RC-01/2022/NIA/JMU, which originates from FIR No. 32/2022 registered at Kulgam Police Station. The charges against them include alleged offences under Sections 13, 16, 18, and 20 of the Unlawful Activities (Prevention) Act (UAPA), Section 302 of the Indian Penal Code (IPC), and Section 7/27 of the Arms Act.

Previously, a general warrant for the arrest of Khan and Bhat had been issued by the court. However, the warrants were returned unexecuted as the accused could not be traced. The prosecution contended that Bhat and Khan have gone into hiding or is deliberately evading arrest.

Taking note of this, the court has directed both Khan and Bhat to appear before it within 30 days from the date of publication of the proclamation. Failure to comply will result in proceedings under Section 83 CrPC, which empowers authorities to initiate the attachment of the absconders' properties.

The Senior Superintendent of Police, NIA Jammu, has been instructed to ensure the widespread publication of the proclamation notice. It will be published in widely circulated newspapers, including one in the accused’s residential area and a national daily. Additionally, the notice will be prominently affixed to a conspicuous part of their residences and other public places in their locality to ensure maximum outreach.

The case is part of an ongoing investigation into terror-related activities in Jammu and Kashmir, with authorities intensifying efforts to bring the accused to justice.
