Srinagar, Nov 28: A court in Uri has sentenced a driver to two years imprisonment after his conviction in a case related to an accident his vehicle met with more than a decade ago at Thajal in north Kashmir’s Uri, leading to the death of three passengers and injuries to 12 others.

The Court Of Judicial Magistrate 1st Class Uri, Fozia Paul, convicted the accused driver Naseer Ahmad Kaali under Sections 279, 337, 338 and 304-A of the Ranbir Penal Code (RPC) as well as 3/181 and 113/194 of Motor Vehicles Act, after hearing the two sides.

The court noted that the accused was found without a valid driving license and could not produce the same before the Investigating Officer (IO).

“As such, as given in proviso under Section 304-A of RPC that where the death is caused by rash or negligent act by a person driving a motor vehicle without holding a driving license, the minimum imprisonment under this section shall be two years,” the Judicial Magistrate said in the order. “For that reason, it prompts me not to take a compassionate view on this matter.”

Accordingly, the court sentenced the convicted person to undergo simple imprisonment for 2 years and imposed a fine of Rs 5000 under section 304-A of erstwhile RPC.

The court further sentenced the driver to undergo simple imprisonment for a month and imposed a fine of Rs 1000 on him for the offence under Section 279 of the RPC.

Moreover, the driver was sentenced to undergo simple imprisonment for a month under Section 337 of RPC besides a simple imprisonment of six months and a fine of Rs 1000 under Section 338 of RPC.
