Police attach properties of those harbouring terrorists
Srinagar, Nov 1: Police on Wednesday attached the properties of terrorist sympathisers for harbouring terrorists.
A statement of Jammu and Kashmir Police issued here said that the property used by terrorists was attached after obtaining legal sanction from the competent authority in Kulgam.
It said that the residential house of the harbourer of terrorist Riyaz Naikoo was also attached by Special Court Pulwama.
It said that the Police in Kulgam attached the residential house of Sanaullah Mir, son of Muhammad Abdullah Mir of Turigam after obtaining legal sanction from the competent authorities (Divisional Commissioner Kashmir) vide order No DIVCOM-K/RTN/37/2023 dated October 31, 2023.
The statement said that the house was linked in case FIR No 10/2023 under Sections 302 and 307 of the Ranbir Penal Code (RPC), 7/27 of the A Act, and 13, 16, 18, 19, 20, 38, and 39 of the UAPA in which three terrorists were killed in an encounter.
It said that DySP Aman Kumar Thakur and one Army personnel Soumveer were killed while fighting terrorists during the encounter at Turigam.
The statement said that the investigation proved beyond doubt that the house was used for terrorism, sheltering, and harbouring terrorists.
It said that the process had started for the attachment of properties that have been used for terrorism as per Section 2(g) and 25 of the ULP Act.
The statement said that the Police in Awantipora also attached the property of Azad Ahmad Teli, son of Asadullah Teli of Beighpora Awantipora in case FIR No 58/2020 under Section 307 of the Indian Penal Code (IPC), 7/27 of the A ACT, and 16, 18, 19, 20, and 48 of the UAP Act of Police Station Awantipora by the orders of Court of Special Judge Pulwama.
It said that the case was taken in an open court.
The Police statement said that the case was registered concerning an anti-terrorist operation between security forces and terrorists at Beighpora Awantipora in the residential house of Azad Ahmad Teli in which two terrorists Riyaz Ahmad Naikoo alias Zubair-ul-Islam, son of Assadullah Naikoo of Beighpora and Adil Ahmad Bhat, son of Ghulam Hassan Bhat of Panjran Pulwama, both affiliated with Hizb-ul-Mujahideen (HM) outfit were killed.
It said that the accused Azad Ahmad Teli was arrested in the instant case on June 1, 2020, for willfully harbouring and providing shelter to two killed terrorists.
The statement said that the case was challaned against Azad Ahmad and killed terrorists under the relevant sections of law.
It said that the investigation agency satisfied the court that the aforementioned property had been used to give shelter to known terrorists of HM and squarely falls within the definition of “proceeds of terrorism”.
The statement said that the court attached the residential house of the accused Azad Ahmad Teli existing on land measuring 7 marlas bearing Survey No 2317 Min and recorded as ‘Aabadi Deh’ classified as ‘Gair Mumkin Aabadi’.
This kind of attachment order under Section 33 UAPA is the first of its kind for the J&K Police.
