NC has deceived people with hollow slogans: BJP MLA
Srinagar, Nov 6: BJP leader, Ranbir Singh Pathania on Wednesday termed the resolution passed by the J&K Assembly as a piece of paper saying it does not come under the framework of any law or constitution.
Talking to reporters, Ranbir Singh Pathania said the political, and legal viability of the resolution was zero.
"It is a big zero. The rejection of this resolution is the most important and most fact-finding. There are 13 principles of the Assembly Rules of Procedure, which govern the tabling of the resolution. This resolution does not come under that framework. So, this is not a resolution at all," Pathania said. He said the resolution wants to take an opinion of the Assembly on a subject on which the Parliament has already made a law and on which the Constitutional Bench of the Supreme Court has already given its opinion.
"Article 141 of the Constitution states that all courts, all legislatures, and all judiciaries are subject to any decision of the Supreme Court. So, the decision of the Supreme Court is the final word on the subject," he said. He said it was a "good act" of the National Conference, and especially the Speaker who has tried to befool the people of Kashmir while passing this resolution.
"But the people of Kashmir all know that in the last seven decades, the National Conference has deceived them with these hollow slogans, hollow promises, and this is the part of this deception that this resolution was brought today," he said.
He said the moving of this resolution was an attempt to redefine the relations between the Central and the State. "This is an attempt to bring back the special status that does not exist in Jammu and Kashmir. Article 246 of the Constitution of India defines the power of the Indian Parliament to define the Central-State relations. When the Jammu and Kashmir Assembly does not have the power to define it, then under which topic are you bringing this resolution," Pathania said.
He said this resolution under no provision of law, can be allowed to sustain. "This resolution is just a big joke with the people of Jammu and Kashmir. It is a big joke with the integrity of this House, with the respect of this House, with the convention of this House," he said.
Ranbir Singh Pathania said that the ruling party while speaking during obituary references made a mention of Somnath Chatterjee and recalled that when the government put a no-confidence motion against him, he was asked to sign it but he said that he is not from any political party but belongs to the House.
"Yesterday, after listening to the speech, our Speaker applauded him and in the evening, he drafted a resolution with the Minister of National Conference," he said. Ranbir Singh Pathania said the resolution was tabled suddenly wherein it was introduced, seconded and voted. "This is wrong," he said.
He said the introduction of this motion was wrong. "This so-called resolution cannot be even tabled on the floor of this Assembly. This is my specific argument," he said. Ranbir Singh Pathania however said that they will not allow the Speaker to run the business of the House for remaining two days unless he apologises.
"Unless he does not apologise for his action, and does not take it back, till then, the BJP will not allow him to run the House," he said.
