Srinagar, Aug 12: The J&K govt on Monday issued a notification ordering to remit the life imprisonment of five convicts as per the Supreme Court's direction.

The Supreme Court had on 18-07-2024 passed a judgment under section 473 of Bharatiya Nagarik Surakhsha Sanhita, ordering to remit the five convicts, convicted of murder and were serving life imprisonment.

In exercise of the powers conferred under Section 473 of Bharatiya Nagarik Suraksha Sanita, 2023 (BNSS) read with S.O 188(E) of 1974 dated 20*' March 1974 of the Ministry of Home Affairs, Government of India and in compliance to the order dated 18.07.2024 passed by the Hon'ble Supreme Court of India in WP(Crl.) No. 142/2024 titled Mohd. Yousaf Shah & Ors us State of J&K, the Lieutenant Governor is pleased to order that the remaining term of imprisonment of the five (05) life convict prisoners, mentioned in the Annexure to this notification, shall be remitted with effect from the date of issuance of this notification," said an order from the government.

However, their remittance shall be based on conditions that they shall furnish a surety bond and a personal bond to the satisfaction of the concerned Superintendent jail before their release. And shall maintain peace, good character and behaviour in the society.

They shall not indulge in any unlawful activity which is prejudicial to the maintenance of the public order and security of the State, while also ensuring their presence before the concerned Police Station once in every six months. The concerned police station shall keep a watch on the activities of the released prisoners, read the order.

These five individuals had already served many years in prison, with maximum being 24 years one month and 20 days by Des Raj, son of Om Prakash. The second highest number has been served for 21years two months and 23 days by Mohd yousuf Shah, son of Ab Gani Shah. While the third convict Suresh Kumar, son of Kaka Ram has served 17-years four months and 22 days. Another convict, Mohd Bashir, son of Mohd Azam has served 17years one month and 14 days. While the fifth convict Tarseem Lal, son of Rattan Chand has served 16 years 11 months and 10-days, as on 15-07-2024, said the order.
