HC quashes PSA detention of 8 persons

Srinagar, Dec 24: The High Court of J&K and Ladakh Tuesday quashed detention under Public Safety Act (PSA) against 8 persons and ordered their immediate release provided they were not required in other cases.

Allowing their separately filed habeas corpus petitions, a bench of Justice Vinod Chatterji Koul quashed the detention orders of Dawood Fayaz Zargar of Nowhatta, Zahoor Bangroo of Fateh Kadal Srinagar, Naveed Mudasir Wani of Ugergund Pulwama, Gowhar Ayoub Fafoo of Awantipora, Gowhar Mohi ud Din Dar of Drubgam Pulwama, Muhammad Azim Qurishi of Baderhama Shopian, Waqar Bashir Bhat of Kreeri Baramulla and Imtiyaz Ahmad Dar of Redwani Payeen Kulgam.

Each of these detainees had been booked under PSA after the district magistrate issued detention orders against him under PSA.

Zargar had been booked under PSA on April 12, 2023, Bangroo on September 5, 2024, Naveed on January 12, 2023, Fafoo on January 16, 2023, Gowhar Mohi ud Din Dar on April 19, 2023, Muhammad Azim Qurishi on February 7, 2023, Waqar on April 12, 2024 and Imtiyaz on June 22, 2023.

“The failure on the part of the detaining authority to supply the material, relied at the time of making the detention order to the detenu, renders the detention order illegal and unsustainable,” the court said while quashing detention order passed by District Magistrate, Srinagar against Zargar.
