Creating of fake H&ME website, duping of job seeker | Court rejects bail application of accused
Srinagar, Dec 5: The court of special mobile magistrate has denied bail to an accused in the fake Health and Medical Education website case on Tuesday.
The Special Mobile Magistrate, Srinagar ( Railway Magistrate, Kashmir ) Ahsan Malik rejected the bail application of Tahir Ahmad Bhat alias chicken of Anantnag.
Bhat is accused of creating the fake website of the Health and Medical Education department and uploading the fake orders.
The bail application was made through the wife of the accused seeking bail in a case related to FIR No 16 /2023 of cyber police station Kashmir zone Srinagar, offences U/S(s) 66D IT Act & 34, 120B, 468 IPC.
The counsel representing the accused sought bail on the grounds that the applicant has been arrested without any rhyme or reason.
It was prayed that “the applicant has been arrested without following the mandate of section 41-A of CrPc as such the detention of the applicant is illegal based on false and frivolous charges.”
Bhat and four other accused were arrested by the cyber police for duping the innocent job seekers by offering them fake appointment letters in the Health & Medical Education department and uploading them on the cloned website of the department.
During the course of investigation, it surfaced that 10 candidates were allured by the accused persons and provided them with the fake appointment letters. The accused had uploaded the letters on fake website of the department, created by the accused fraudsters.
The Assistant Public Prosecutor ( APP), John Mohammad Wani representing the state stated in the objections that the accused in question is involved in serious cognizable and non bailable offence “as such the accused is part of the group who are involved in creating the fake/clone commercial website in the name of Health & Medical Education Department. Besides fake appointment orders referring to the health & Medical Education Department have also been created and uploaded on the website”.
Wani stated that the accused person in order to tempt the gullible citizens and others purportedly had made some false and frivolous documents in the shape of appointment orders etc, which have been seized from the accused person and their commission & omission of the accused prima facie discloses offences punishable U/S 66D IT Act, 34, 120B, 468 IPC.
The Special Mobile Magistrate in the order observed that the accused persons including accused applicant are habitual criminals and many FIRs are already registered against them in other police stations.
