Court declines bail to woman who impersonated as IAS officer

Srinagar, Nov 1: A court in Budgam Wednesday declined to grant bail to two accused including a woman who impersonated as an IAS officer and defrauded a man with the promise of providing government job to his son in Budgam District last month.

Chief Judicial Magistrate (CJM) Budgam Noor Mohammad Mir rejected bail plea of accused - Ayush Koul (35) wife of Manmohan Ganju, a resident of Raj Bagh Srinagar and Burhan Bashir (25) son of Bashir Ahmad Shah, a resident of Bemina Srinagar.

Koul had impersonated as IAS officer and along with her accomplice Burhan and defrauded a person on the pretext of securing a job for his son.

“The accused persons are involved in serious, heinous and non- bailable offences and they do not deserve the concession of bail,” the Court said, adding, “ the investigation of the case is at early stage and there is every likelihood that the accused may deceive the prosecution witnesses from disclosing true facts before the investigating agency”.

The Court underscored that there was every apprehension that if the accused were granted the bail, they would attempt to influence the process of investigation. “And thus accused are held not entitled to bail at this stage,” the Court said, and rejected their bail application as meritless. A case bearing FIR number 302 of 2023 was registered at Police Station Budgam against the two accused for the commission of offences under section 420, 419, 120-B of IPC.

Meanwhile the court requested the SSP Budgam to organize a awareness programme for senitizing investigating officers of District Budgam regarding the mandate and compliance of section 41, 41-A of Cr.P.C, the directions passed by the Supreme Court in “Arnesh Kumar Vs. State of Bihar (2014) SCC 273 case and Satinder Kumar Antil versus Central Bureau of Investigation & Anr”.
