CAT orders release of employee’s provisional pension
Srinagar, Oct 24: The Central Administrative Tribunal (CAT) in Srinagar has directed the authorities to release the provisional pension in favour of an employee who had been retired compulsorily in December 2021.
Syed Ashaq Hussain, an employee of Cooperative Department had approached the Tribunal seeking its intervention for release of his provisional pension.
“In view of the limited prayer made by counsel for the applicant, respondents are directed to release the provisional pension in favour of the applicant under Regulation 168-D of J&K CSR on the same analogy as has been done in the case of a similarly placed person, namely Mohammad Mujeeb Rehman,” a bench of Member (J) D S Mahra said in its order.
The court ordered that the provisional pension be released within two months in favour of Hussain notwithstanding the order dated 27-09-2023, issued by Director Finance, Cooperative Department. The director Cooperative Department vide this order had laid own that suspension period of Hussain with effect from September 2020 to December 2021 needed to be decided by competent authority before processing his provisional pension case.
The direction came in response to the submission by advocate Faizan Bhat that it would suffice if a direction was issued to the respondents to release the provisional pension in favour of the applicant under Regulation 168-D of J&K CSR as the same had been done in the case of another similarly circumstanced person.
