CAT dismisses medico's transfer plea

Srinagar, Nov 9: Observing that patients’ care is supreme and cannot be compromised, the Central Administrative Tribunal(CAT) has rejected the plea of a medico whereby he had assailed his transfer order.

“An employee has no fundamental right for that matter a vested right to claim a transfer or posting of his or her choice and individual convenience of the person who is employed in the service is subject to the overarching needs of the administration,” bench of M S Latif, Member (J) said.

The petitioner, a radiologist had assailed the government order dated 25-10-2023 wherein it was indicated that he was transferred “in the interest of administration and patient care from District Hospital Ganderbal and deputed to Government Medical College Udhampur for a period of two years on the standard terms and conditions of deputation”.

The main ground of challenge to the transfer order was that the consent of the petitioner had not been sought.
