Srinagar, Jul 29: A court in Kulgam Tuesday awarded life sentence to a woman and her paramour for killing her husband in 2013. Principal Sessions Judge Kulgam, Aijaz Ahmed Khan sentenced Muzamil and her paramour Ali Muhammad Dar to life imprisonment under section 302 of RPC following the conviction of the duo in the case.

It also ordered a fine of Rs 3, 00,000 for the offence to be paid by Ali Mohammad Dar. In default of payment of fine, he has to undergo further simple imprisonment for one year. The Court quantified the sentence with the observation that “justice demands that courts should impose punishment befitting the crime, reflecting public abhorrence of the crime”.

“The courts must not only keep in view the rights of the criminal but also the rights of the victim of crime and the society at large while considering imposition of appropriate punishment”. “Undue sympathy to impose inadequate sentence would do more harm to the justice system to undermine the public confidence in the efficacy of law and society could not long endure under such serious threats”.

The Court underscored that it is the duty of every Court to award proper sentence having regard to the nature of the offence and the manner in which it was executed or committed. The prosecution story revealed that the body of Ab Rashid Dar of Modergam was found hanging from a tree on December 21, 2013 in Kulgam district of south Kashmir.

Following the Postmortem conducted on the body of the deceased, it was observed that his private parts were squeezed and neck was broken, leading to the suspicion that some persons have killed Dar and kept his body hanging from a tree, according to police.

Several suspected persons were questioned and upon interrogation, one Ali Muhammad Dar of Modergam disclosed that he had illicit relations with Muzamil, the wife of the deceased Dar and accordingly they prepared a plan to eliminate him.

According to police on the date of occurrence both, the woman and her paramour gave some medicines to the deceased and he got unconscious. Thereafter, his private parts were squeezed and his mouth and nose were closed while his neck was broken with which the deceased got killed. During the night, the deceased was taken to a field and kept hanging from a tree.Following the charge-sheet filed in the court and conclusion of the trial in the case, the Principal Sessions Judge, Kulgam convicted the duo on July 17 for murdering Rashid who is survived by a daughter and two sons. Meanwhile, the court recommended the case of the family of the deceased to Chairman District Legal Services Authority Kulgam for compensation.
