The state government on Thursday informed the High Court that despite repeated communications by investigating officer (IO) probing human shield case against Major Leetul Gogoi, the army has not furnished “nominal roll” of the army personnel of the vehicle bound party.

“Despite chain of communications and subsequent reminders the coy commander of 53-RR camp Beerwah has not provided the nominal roll of the army personnel of the vehicle bound party,” reads the government’s stats report filed in high court.

After hearing advocate Rehana Fayaz on behalf of the petitioner, a bench of Justice Janak Raj Kotwal listed the case in first week of February 2018.

The government informed the court that two more communications have been dispatched once again to commanding officer 53 RR C/O 56 APO and company commander 53 RR camp Beerwah and till date no response has been received from them.

The court was also informed that the investigation of the case was going on and after the police “obtains reports from District Election Officer Beerwah, company commander 53 RR camp Beerwah, and expert opinion with regard to video clip related to the victim from CFSL Chandigarh, the investigation of the case will be concluded.”

In its report police has also indicated that it has recorded statements of 11 witnesses besides that of victim, Farooq Ahmad Dar.

The police said during investigation as also according to the statements of witnesses recorded, it has come to the surface that on 9-4-17 when Srinagar-Budgam went for polls, the victim had proceeded to village Gampora for condolence purpose. “While reaching at Utligam crossing, where a mob had assembled and was pelting stones upon security forces, the victim was lifted by the Army and tied to bonnet of the vehicle as human shield under threat, was kept under wrongful confinement and was moved within the area,” it said.

On November 21, the High Court had directed the State government to inform it within two weeks about the investigation of the case against Major Leetul Gogoi in human shield incident.

Major Gogoi had tied Farooq to the bonnet of jeep as a human shield and paraded him to several villages.

Advocate Qureshi submitted that investigation of the case should be carried out speedily so that the culprits can be punished for the inhuman act.

“Statements from seven witnesses have been recorded already and the court should be informed what more has been done with regard to the investigation,” he said.

State counsel B A Dar however submitted that the police was doing the investigation.
